1. Who is who
klyo games at games.klyo.pl (formerly gry.klyo.pl), together with the developer studio at dev.klyo.pl, is run by Klyo Illia Krasnopolskyi, tax ID (NIP) 7822656871, business ID (REGON) 520721748, based in Łódź, Poland (klyo). A developer is a person or company that creates a studio account and uploads a game. Accounts are for adults; a minor needs a guardian's consent and the guardian's details for payouts.
2. Your account
You sign up with an e-mail address and a password. The account is for games only: uploads, status, stats, settlements and the community. It does not open any other klyo service. You are responsible for what happens on it, so do not share the password. You can delete the account any time by writing to kontakt@klyo.pl; we keep the data required for tax records for as long as the law requires.
Minors (13–17) upload games without giving any personal details. The revenue share is paid to the details and bank account of a guardian, who confirms consent to this agreement in the payout form (Article 17 of the Polish Civil Code).
3. What you may upload
A game you hold the rights to: made by you, by a team that agrees to publish, or licensed to you for this use. The game runs in a browser from a single index.html, with no install and no player account. The game must not show its own ads or load third-party ad networks, collect player data, ask for logins or payments outside klyo tools, contain malicious code (crypto miners, tab hijacking, phishing: a package with such traces is rejected automatically and a repeat closes the account), unlawful content, pornography, hate speech or someone else's trademarks without permission. A package may contain only web files: no programs to run on a computer. Content for older players (violence, fear, strong language) is declared in the questionnaire at upload; it decides the age label on the game page, whether ads run next to the game, and whether the game enters the klyo games apps in the stores.
We do not accept sexual content at all. Games rated 18+ for violence — yes, those we publish with an age label. Nudity, sexual and suggestive content are refused, with no exception. The reason is practical, not moral: Google Play and the App Store ban such content in apps, so one such game would take the klyo games app away from every developer at once, and for the ad account it would be a risk whose consequences would land on everyone's payouts. Publish an adult game on itch.io or Newgrounds — here you can publish your other games.
When you submit a game you confirm separately that it contains no sexual content. The content survey asks about it directly; an untrue answer breaches these terms and is grounds for closing the developer account.
4. Licence: the rights stay yours
By uploading you grant klyo a non-exclusive, royalty-free licence to store and serve the game to players on the portal address, on the game's own address (g-yourgame.klyo.pl) and inside the klyo games mobile apps, to show its name, description, images and short previews in the catalogue, on social media and in material promoting the portal, and to make minor technical changes needed to run it (such as file compression). The licence is worldwide and lasts as long as the game is in the catalogue. When you remove the game the licence ends; previews and mentions in material already published may remain. You transfer no rights to klyo, there is no exclusivity, and you may publish the same game anywhere else.
5. Check and publication
A program checks the package: size, file count, paths, extensions, the start file and traces of third-party ad networks. A game that passes is published immediately. A person looks at it after publication. We may remove a game that breaks section 3, does not work, cannot be played on phone and desktop, or is the subject of a credible report of a legal or rights violation. You then get an e-mail with the reason and may appeal to the same address; we answer within two working days. Players can report a game with the button next to it.
We do not change your game's files. We serve them at g-yourgame.klyo.pl exactly as you uploaded them: no injected scripts, no ads added inside the game, no edited content. The one exception is explicit and concerns moving a game from another portal: we then remove scripts loaded from other people's servers (for example the itch.io helper that stops a game embedded outside itch.io) and show you which ones. The game remains yours — you can pause it, replace it with a new build or delete it at any time, and we then delete its files and its page.
6. Ads and your share
Next to games we show Google AdSense ads from klyo's account. The ad stands beside the game; an in-game break can be placed only by the developer through the klyo SDK. Your share is 70% of the net revenue from ads attributed to your games. Net revenue is the amount Google pays klyo for a given month for ads next to games, after taxes and payment fees due.
Attribution is simple and checkable: the developer pool for a month is split between developers' published games in proportion to each game's starts in that month. A start is a player starting the game, counted on our side after a token issued at the beginning of a round and a minimum play time, with no data about the player. In the studio you see your starts day by day and the amount accrued for each closed month. We do not disclose per-click rates or other data Google treats as confidential.
As of today: the portal is waiting for Google AdSense approval. Ads are not being shown yet, so there is no revenue and nothing to split. The share stated above starts to apply from the first payment Google makes to us — we write this plainly so that nobody uploads a game believing they will earn this month.
Not every country brings money in. Google ads are not shown everywhere. Since 2022 Google has not sold ads to audiences in Russia, and in embargoed countries it does not provide services at all. A player from there starts your game like anyone else and nobody blocks them, but their round brings no revenue, so it does not grow the pool being split. We say this plainly, because “publish a game and take a share of the ads” would read differently if your players happened to be from there.
7. Payouts
We close a month by the 15th of the following month. We pay by bank transfer to the account given in the studio once the accrued amount reaches 100 PLN; smaller amounts roll over to the next month. The transfer goes out within 14 days of both conditions being met: the threshold and complete settlement details. Artificially inflating starts (bots, scripts, click exchanges) is grounds for withholding payment and removing the game.
Which details and when. Registration and publishing need nothing beyond an e-mail address. Settlement details (name or company name, address, country of tax residence, bank account, tax ID for a company) are asked for only when your accrued amount approaches the payout threshold. We never ask for an ID scan or a selfie: klyo is not an obliged institution under the Polish anti-money-laundering act, and the owner of the bank account has already been verified by their bank. We pay only by our own bank transfer, not through payment intermediaries that would require document verification from you.
Where we are allowed to pay. The transfer leaves a Polish bank, so sanctions and payment rules bind us. We will not send money where European Union law forbids it: today this includes Russia and Belarus, among others, and embargoed countries. You can publish a game with us from anywhere in the world and nobody will block it for that reason. If you live in such a country, however, we cannot pay out until the rules change or you give a bank account in a country the transfer is allowed to reach. We say this before you upload a game, not after the first amount has accrued. Sanction rules change over time, so we check the current state at every payout and write to you when something changes.
Cents and transfer fees. Your share is calculated to the cent: the pool is divided with no remainder, and the cents left by rounding go to the games with the largest remainder, so the sum of payouts always equals the pool and nothing stays on our side. The transfer itself goes out in whole zlotys; the leftover cents stay on your balance and are added to the next payout, so the bank statement stays readable and nothing is lost. Transfers within Poland and the euro area cost nothing and we deduct nothing for them. The general rule is that the cost of delivering money is borne by whoever receives it: if your payout requires a fee (a transfer outside the euro area, or a payment provider's commission when you choose that route), we deduct it from your amount, show it before the transfer and raise the threshold so the fee cannot eat half of your money. In the same way we bear the cost of receiving money from Google or from an advertiser, and we do not add it to your share.
8. Taxes and documents
Individuals in Poland. Your payout is licence income. klyo withholds income tax advances, pays them to the tax office and sends you a PIT-11 form after the year ends. You do not need a business or to issue anything.
Businesses in Poland. You invoice klyo for the accrued amount; VAT payers add tax at the rate applicable to licences. The basis is the settlement statement in the studio.
Developers outside Poland. Polish withholding tax (as a rule 20%) may apply unless you provide a tax residency certificate from your country, in which case the double-taxation treaty applies. EU businesses invoice with reverse-charge VAT.
As a platform we may be required to report your earnings to the tax administration under EU platform-reporting rules (DAC7) once you cross the statutory thresholds in a year. This is why we ask for identification details before the first payout.
9. Stats and player data
We count game page views and starts. We do not collect data about players and pass none to you. Your game runs on a separate address, so it has no access to klyo cookies or to other games, and the other way round.
10. Reports, takedowns and appeals (Digital Services Act)
Anyone can report a game or a community post on the Report a violation page or at kontakt@klyo.pl, giving the address, the reason, their details and a good-faith statement. A credible report of illegal content, someone else's game or malicious code leads to a takedown within 24 hours, and immediately where there is no doubt. The developer receives a statement of reasons by e-mail: what was removed, why and how to appeal. Appeals go to the same address; we answer within two working days. Repeated violations (the third in a year) end with account closure, removal of all games and withholding of unpaid amounts pending clarification. We keep a register of moderation decisions (date, reason, outcome of the appeal).
11. Changes and governing law
We announce changes to these terms by e-mail to the account address at least 14 days in advance; if you disagree, you remove the game before the changes take effect. Polish law applies. Disputes go to the court competent for klyo's seat, or, if you are a consumer, the court competent under consumer protection rules. The binding text is the Polish version.
